Police Brutality IHOP Tulsa Police Department 71st and Lewis Saturday night / Sunday morning at approx 1:30am Tulsa, Oklahoma

Two friends and I were eating at an IHOP when the table next to us got loud on a Saturday night. (Surprise right?) There was a Deputy sitting at a table a few tables away and he came over and told them to "Shut up or I'll throw you out." They quieted down and a few minutes later started to talk loud again. The Deputy came back and repeated his threat and then turned on our table and said the same thing. When I told him that he didn't have the authority to throw us out and that only the proprietor could do that he became upset and even more threatening in his tone and body language. He stood at the end of the table and said Oh yes I can and about 10 seconds later a manager came over and asked me to leave.
I obliged, gathered my things and headed towards the cash register. On the way to the cash register this "Deputy" was physically pushing me from behind and I told him to keep his hands off of me. I would walk a few more steps and he would push me again.
Once I was at the register paying my bill my friend who is a Sgt. in the Army, 9 year veteran and 2 tour Iraqi Freedom veteran was physically pushed by this Deputy as well and they got in a small scuffle.
I paid my bill and the Deputy followed me out (less than a foot behind me) and once we got out in front of the restaurant he shoved me and made me stumble. I turned around and told him to keep his hands off of me! He grabbed my sport jacket and said "you're going down". The jacket came off, he grabbed my shirt, I grabbed his to steady myself, he shoved me down and when I recovered he had his taser drawn and the video picks it up from there.
At no point did he state I was under arrest but I was asking him why he was arresting me. He said "you're resisting arrest" and I said that isn't good enough, you have to have a reason to arrest me to begin with. At no point did anyone tell me I was under arrest and the Tulsa Police Department that showed up in the arrest videos didn't communicate anything to me. They came up behind me and grabbed me. At no point did I try to resist or become combative.
They smashed me in the face with an elbow, I have a few large cuts on my forehead and if you watch the video closely when I cry out in pain the Deputy has my ankle and intentionally twists it to cause bodily injury.
I have a "very severe sprain" according to my doctor.
They charged me with Public Intox, Trespassing, and Resisting Arrest.

ReplyDeleteI agree it was wrong. But fighting back never works.
ReplyDeleteThis is just a huge display of ignorance and self entitlement. The police officer is NOT required to tell you what you are under arrest for until you are being turned in to booking. You were not listening to commands of the Deputy, who at that time had PROBABLE CAUSE to believe you were intoxicated . Even if you weren't, that is something you fight in court, not stand there and argue with an officer of the law. Probably the only reason the Deputy didnt taze you was the rowdy crowd had him outnumbered and that is dangerous. TPD arrived and did the right thing, used the amount of force needed to make the arrest. You WERE resisting. Holding your arms over your head and laying on your back when you're being told to lay on your stomach and put your hands behind your back is called PASSIVE RESISTANCE. You do NOT have the right to stand in public and argue with an officer of the law when he gives you lawful command. Maybe you should read a little law before you try to argue with the ones who are paid to know and enforce it. I hope you take this to court and the judge LAUGHS IN YOUR FACE. Your ignorance astounds me.
